Attorney's Fees and Costs

One highly overlooked consideration in a divorce is attorney's fees and costs. In contested matter, the expense of fighting out the issues in court can run in the tens of thousands of dollars. Costs such as expert fees can add to this significantly. As a result, the right to recover attorneys fees and costs can be an inmportant consideration. The divorce court can award fees and costs when one party has a need and the other party has the ability to pay. As with many areas of divorce law, the entitlement to an award of fees and costs is in the discretion of the court. As a result, the parties cannot count on their attorney's fees or costs being awarded and should therefore make other arrangments to cover these expenses.

The cost of a disputed divorce is another reason that the parties should make every attempt to try to reach a settlement or resolve the divorce in mediation.
